Why choose Wise Owl Wills

27 years of legal experience focused on you and your family.

Wise Owl Wills was founded by Stephen Rhodes, who was called to the Bar in 1999 and has 27 years of legal experience. Having drafted Wills and dealt with disputes arising from poorly prepared or unclear Wills, Stephen understands both how these important documents should be prepared and what can go wrong when someone’s wishes are not expressed properly. You deal directly with Stephen throughout, from your first conversation to the completion of your documents.

Wise Owl Wills is an independent Will-writing and estate-planning business, not a barristers’ practice, and Stephen does not provide these services in the capacity of a practising barrister. Instead, you receive the benefit of his extensive legal knowledge and experience through a personal, approachable service, with clear explanations, fixed fees agreed in advance and no unnecessary legal jargon.

Whether you require a Will, Lasting Power of Attorney or Living Will, Stephen will take the time to understand your circumstances, explain the available options and prepare documents tailored to your needs and wishes. His aim is to make planning for the future feel straightforward and reassuring, while ensuring that you can make informed decisions with confidence.

A clear Will that reflects your life and your wishes

A Will gives you control over what should happen to your estate, who should deal with it and how the people you care about should be provided for. Without one, the intestacy rules decide who inherits. Those rules cannot take account of informal promises, personal relationships or the individual reasons behind your choices.

I help people throughout Oldham put properly considered arrangements in place. This includes individuals and couples making their first Wills, parents choosing how children should be provided for, homeowners considering trust provisions and families whose circumstances do not fit a standard template.

Every Will is prepared personally. I take time to understand your family, property and priorities, explain the available options in plain English and agree the fee before any drafting begins. You will not be directed through an automated Will builder or left to choose legal clauses without guidance.

A Will deals with what happens after your death. If you also want to choose who could make financial, health or welfare decisions during your lifetime, or record particular medical treatments you would refuse, I can prepare Lasting Powers of Attorney and a Living Will as part of the same planning exercise.

Professional Will writing across Oldham

Oldham brings together a fast-growing town centre, settled residential suburbs and the semi-rural villages of Saddleworth, but the question that matters is personal: if something happened to you, would the law hand your home and your savings to the people you’d actually choose? A professionally drafted Will can address the people, property and responsibilities that matter in your own life.

The case for having one in place is particularly strong here. Oldham has one of the youngest and fastest-growing populations in Greater Manchester: the median age is 37, against 40 across England and the North West, and the population grew by 7.6% between 2011 and 2021, faster than both. Oldham is also one of the most ethnically diverse boroughs in Greater Manchester, with 24.6% of residents identifying as Asian, mainly of Pakistani and Bangladeshi heritage, and cultural or faith-based wishes around inheritance often matter as much as the legal mechanics. Average household size is 2.6, higher than most neighbouring boroughs, reflecting a borough where multi-generational households and close extended family ties are common. For an Oldham parent, that combination means the question of who would care for your children if something happened to you needs a clear legal answer, one that only a Will can give. For a family with several generations under one roof, or living close by, it means being specific about who you want to benefit rather than leaving it to a fixed legal formula that only recognises certain relationships.

A Will may be particularly important for unmarried couples, parents, blended families and anyone who wishes to protect a young or vulnerable beneficiary. The right structure depends upon your circumstances, which is why the consultation comes before the drafting.

As the commercial and residential heart of the borough, Oldham Town Centre is home to a fast-changing population, including many young renters, first-time buyers benefiting from regeneration investment, and long-standing local families with deep roots in the area. This mix creates a wide range of Will-writing needs.

For younger residents and first-time property owners, many of whom may never have considered a Will before, I provide clear, jargon-free guidance that explains exactly why having a Will matters, even when an estate feels modest.

Many residents in the town centre also live in private rented accommodation or shared family homes, meaning a Will is essential to clearly set out who should receive savings, personal possessions and any other assets, since these arrangements are not always covered by default legal rules. I also regularly assist unmarried couples living together in the town centre, making sure their partner is protected and provided for, something the law does not guarantee automatically.

At Wise Owl Wills, I offer convenient appointment options across Oldham Town Centre, including evening and weekend availability to suit working residents, plus telephone and video consultations. My straightforward, fixed fee approach means there are no hidden costs, just clear professional advice tailored to your circumstances and your community.

As one of the borough’s most settled residential areas, Chadderton has a high proportion of homeowners, many of whom have lived in the same property for decades and built up significant equity over time. This makes Will writing particularly important for protecting that asset and ensuring it benefits the right people.

I also see strong demand among Chadderton families for guardianship provisions, since the area is home to many households with school-age children, and parents want clear legal certainty over who would raise their children if both parents were to die.

Retired residents form another significant part of the community, and I often help with reviewing and updating older Wills to reflect changing family situations, additional grandchildren, or the wish to leave specific gifts to charities or causes close to their heart. For Chadderton’s unmarried couples, a Will is especially important, since cohabiting partners have no automatic right to inherit under the rules of intestacy, regardless of how long they have lived together.

At Wise Owl Wills, I provide a personal, attentive service across Chadderton, with free home visits for those who prefer to discuss their Will in familiar surroundings, plus telephone and video consultations for added convenience. With transparent fixed fees and no hidden costs, every client receives professionally drafted documents that genuinely reflect their wishes and protect the people who matter most.

Failsworth sits at the gateway between Oldham and Manchester, and its population reflects that position, with many residents commuting daily for work and a strong number of young families who have moved to the area for its accessible housing and good schools. This combination brings specific and practical Will-writing needs.

First-time buyers and those with growing mortgages need a Will to protect their stake in the property and ensure it benefits their chosen beneficiaries, particularly important given how much of a family’s wealth in Failsworth tends to be tied up in the family home. Parents throughout the area are understandably focused on guardianship arrangements for young children, wanting clarity and certainty rather than leaving such an important decision to the courts.

I also work with many Failsworth residents who are self-employed or run small businesses locally, helping ensure business assets are dealt with clearly and do not create unnecessary complications for surviving family members.

For busy working households balancing commuting, careers and childcare, convenience matters, which is why I offer flexible appointment times, including evenings and weekends, alongside free home visits and remote consultations. My straightforward, fixed fee approach removes any uncertainty about cost, allowing Failsworth residents to put a proper Will in place quickly and without unnecessary stress, fitting around already busy lives.

Hollinwood’s strong sense of community and long-standing local families mean that many residents have close ties to the area spanning multiple generations, often living near siblings, parents or grandparents. This creates particular priorities when it comes to Will writing.

For households with more limited assets, I make clear that a Will is not just for the wealthy, it is the only way to ensure that everything you own, no matter the value, is passed on according to your own wishes rather than a fixed legal formula that ignores personal relationships and circumstances. I frequently help Hollinwood residents provide for specific family members beyond their immediate household, including informal arrangements such as supporting a relative who has been a long-term carer, something that would not be recognised at all without a clearly written Will.

Parents in the area also prioritise guardianship provisions, wanting certainty about who would care for their children if anything happened to them. For residents renting their home or living in family-owned property, a Will helps clarify exactly what happens to personal possessions and any savings, avoiding confusion among family members during an already difficult time.

At Wise Owl Wills, I provide a friendly, approachable service across Hollinwood, with free home visits for those who prefer to discuss matters at home, plus telephone and video consultations. My transparent fixed fees mean every resident can access professional Will writing without unexpected costs.

With its village-like character and close-knit community, Lees is home to many long-term residents who have built up significant equity in family homes, alongside a number of properties with larger plots, outbuildings or land that goes beyond a typical residential garden. This combination creates specific Will-writing needs.

For residents with additional land or outbuildings, whether used for storage, hobbies or small-scale business purposes, it is important that a Will clearly addresses these assets separately from the main residence to avoid confusion or delay during probate. Many Lees families also have strong multi-generational ties, with grandparents, parents and children often living close to one another, making it important to set out clear and specific wishes to prevent misunderstandings among family members.

Parents across the area also prioritise naming legal guardians for their children, wanting reassurance that their wishes would be respected and followed without hesitation. I also assist residents reviewing Wills that have become outdated due to property improvements, family growth or changes in personal relationships.

At Wise Owl Wills, I provide a personal, unhurried service across Lees, with free home visits for those who prefer to discuss their Will at home, as well as telephone and video consultations. My transparent fixed fees and clear documentation give Lees residents complete confidence that their property, land and family are properly protected.

As a sought-after residential area combining established neighbourhoods with newer family housing, Royton attracts a broad mix of homeowners, from those who have lived locally for many years to younger families recently settled in the area. This creates a wide range of practical Will-writing needs.

For homeowners with significant equity built up over time, a Will is essential to ensure their largest asset passes smoothly to the people they intend, rather than according to fixed legal rules that may not reflect personal wishes. Many Royton families also want to address fairness between children, particularly where financial support has previously been given unevenly, such as help with a deposit for one child but not another, and a carefully drafted Will allows these matters to be addressed clearly and sensitively.

Parents throughout the area place high importance on guardianship provisions, wanting full confidence that their children would be raised by someone they trust without court involvement. I also support residents in blended families, ensuring that both biological and stepchildren are provided for according to personal wishes, something that does not happen automatically without a Will.

At Wise Owl Wills, I offer flexible appointments across Royton, including free home visits, telephone and video consultations to suit busy family life. My fixed fee approach means clear, upfront pricing with professionally drafted documents tailored entirely to your circumstances.

The Saddleworth villages, including Uppermill, Delph, Dobcross, Diggle, Greenfield and Grasscroft, are home to many residents with substantial property wealth, often built up over decades in one of the borough’s most desirable semi-rural locations. This creates distinct and often more complex Will-writing requirements.

With higher average property values across the area, inheritance tax planning becomes an important consideration for many Saddleworth families, and a well-drafted Will can help structure an estate in a way that minimises unnecessary liability while still reflecting personal wishes. I also work with residents who own farmland, smallholdings or equestrian properties, where specific provisions are needed to ensure land and associated assets are dealt with correctly and pass on smoothly to chosen beneficiaries.

Many Saddleworth households include several generations of family wealth, and I help ensure that gifts to children and grandchildren are structured thoughtfully, sometimes including trusts to protect inheritance for younger beneficiaries. Business owners across the area, including those running independent shops, professional practices or rural enterprises, also benefit from clear succession planning within their Will to protect the future of the business.

At Wise Owl Wills, I provide a discreet, thorough service across Saddleworth, with free home visits, telephone and video appointments available. My fixed fee structure ensures transparent pricing even for more complex estates, backed by experienced, professional guidance.

With its mix of traditional terraced streets and larger family homes, Shaw and Crompton appeal to a broad range of residents, from long-established families to commuting professionals. This variety brings a range of practical Will-writing needs.

For homeowners who have lived in the area for many years, ensuring property passes smoothly to chosen beneficiaries is often the central concern, particularly where a family home represents the majority of the estate. Many local families also want to make specific provisions for adult children, especially where one child has remained nearby and provided ongoing support to parents, while others have moved away.

Parents of younger children prioritise guardianship arrangements, wanting clear, legally recognised instructions about who would raise their children if necessary. I also regularly help residents update Wills that have become outdated due to changes such as remarriage, a new baby or a house move within the area.

For commuting professionals with busy schedules, convenience matters, which is why I offer some evening and weekend appointments alongside free home visits, telephone and video consultations. My transparent fixed fee structure ensures residents of Shaw and Crompton can put a properly drafted Will in place without unnecessary cost, delay or inconvenience to their working life.

Tucked between Oldham and the Saddleworth villages, Springhead and Grotton offer a settled, semi-rural lifestyle that appeals to long-term homeowners and families seeking a quieter alternative to more urban parts of the borough. This creates specific and practical Will-writing needs.

For residents who have built up significant equity in their homes over many years, ensuring property passes smoothly and according to their wishes is often the central concern when writing a Will. Many local households also include close extended family living nearby, such as parents, adult children or grandchildren, and a Will allows residents to make thoughtful, specific provisions reflecting these close family connections rather than relying on default legal rules.

Parents in the area place particular importance on naming guardians for younger children, wanting full certainty over who would care for their family if necessary. I also help residents review older Wills that may no longer reflect current circumstances, such as a property extension, a new relationship or additional grandchildren.

At Wise Owl Wills, I provide a personal, unhurried service throughout Springhead and Grotton, with free home visits for those who prefer to discuss matters from home, as well as telephone and video consultations. My transparent fixed fees mean residents can put a properly drafted Will in place with complete confidence and no hidden costs.

Positioned between Oldham town centre and the open countryside towards Saddleworth, Waterhead attracts homeowners who value extra space, larger gardens and a slightly more rural feel while remaining close to local amenities. This setting creates distinct and practical Will-writing needs.

For residents with larger properties or land attached to their home, a Will must clearly identify and address these additional assets separately to avoid confusion or delay during probate. Many Waterhead households also include close family living nearby, such as parents, siblings or adult children, and a well-drafted Will allows residents to make specific, thoughtful provisions reflecting these close family ties rather than relying on default legal rules that may not match personal wishes.

Parents across the area place significant importance on naming guardians for younger children, wanting full confidence and legal certainty over their family’s future care. I also frequently assist residents updating older Wills that no longer reflect current circumstances, such as a property extension, a change in relationship status or the arrival of additional grandchildren.

At Wise Owl Wills, I provide a calm, attentive service throughout Waterhead, with free home visits for those who prefer to discuss their Will at home, as well as telephone and video consultations for added convenience. My transparent fixed fees ensure complete clarity and confidence from the very first conversation.

A home appointment provides the same opportunity to discuss your circumstances and ask questions as a remote appointment. If you want more than one service, your Will, LPA and Living Will requirements can usually be discussed together.

Which type of Will might you need?

The following summary explains the available services. The final recommendation will depend upon your instructions and the protection you want to achieve.

Service When it may be suitable

Lasting Powers of Attorney and Living Wills

Many clients first contact me because they need a Will and then ask whether they should make arrangements for decisions during their lifetime. I also prepare Lasting Powers of Attorney and Living Wills. These can be arranged alongside your Will or as separate services.

Lasting Powers of Attorney

Blue illustration of a Lasting Power of Attorney document with a pen and official seal

A Lasting Power of Attorney allows you to appoint trusted people to make particular decisions or act for you. A Property and Financial Affairs LPA can cover matters such as bank accounts, bills, investments and property. A Health and Welfare LPA can cover care, medical treatment and where you live, but it can be used for a particular decision only when you lack capacity to make that decision yourself.

Lasting Power of Attorney fixed fees

Choose a Property and Financial Affairs LPA, a Health and Welfare LPA, or both, and give people you trust the authority to act if you can no longer make particular decisions yourself.

Office of the Public Guardian registration fee: £92 for each LPA, payable to the OPG when you register your LPA. A reduction or exemption may be available depending upon the donor’s income or benefits.

Living Wills

Illustrated Living Will document with a pen, signature and blue seal

A Living Will, formally called an Advance Decision to Refuse Treatment, records specified medical treatments that you wish to refuse in defined future circumstances if you cannot make or communicate the decision at that time. It serves a different purpose from a Health and Welfare LPA, although the two documents are sometimes considered together.

Living Wills fixed fees

Choose the Will that provides the right protection for you and your family. Every Will is personally prepared for your circumstances, with clear guidance and a fixed fee agreed before drafting begins.

Frequently Asked Questions in Oldham

Yes. I provide professional Will-writing services across the Metropolitan Borough of Oldham, including free home visits to clients in Oldham Town Centre, Chadderton, Failsworth, Hollinwood, Lees, Royton, Saddleworth, Shaw and Crompton, Springhead and Grotton, and Waterhead. Telephone and video appointments are also available if you’d prefer to arrange your Will remotely. I work with homeowners, young families, business owners and residents with property in more rural areas, and I tailor my advice accordingly. My service is built on clear advice, transparent fixed fees and professionally drafted documents tailored to your individual circumstances. To arrange a free consultation, call me on 0161 524 1033 or complete my  contact form.

Yes. I offer free home visits to clients across the Metropolitan Borough of Oldham. Whether you live in Oldham Town Centre, Chadderton, Failsworth, Hollinwood, Lees, Royton, Saddleworth, Shaw and Crompton, Springhead and Grotton or Waterhead, I can come to you at a time that suits you. Home visits are particularly valued by older residents, busy parents and those with mobility concerns, giving you the opportunity to talk through your circumstances in a relaxed environment with no need to travel or arrange childcare. If a home visit isn’t convenient, telephone and video appointments are also available. To arrange a free home visit, call me on 0161 524 1033 or complete my  contact form.

Yes. Your instructions can be taken by telephone or video, and you’ll receive the same personal discussion and tailored drafting as you would during a home visit. I’ll also explain exactly how your completed Will needs to be signed and witnessed to be legally valid, since that’s the one part of the process you’ll need to arrange yourself wherever you are.

A Will records what should happen to your estate after your death. A Lasting Power of Attorney appoints people you trust to make decisions or act on your behalf during your lifetime, if you’re ever unable to do so yourself. A Living Will (formally an Advance Decision to Refuse Treatment) records specific medical treatments you would refuse in defined future circumstances. Many clients arrange a Will on its own; others choose to put an LPA or Living Will in place at the same time. Find out more about Lasting Powers of Attorney and Living Wills.

A Single Will costs £130 and Mirror Wills for a couple cost £200. A detailed Will including a trust costs £200, or £300 for detailed mirror Wills for a couple. I’ll explain which option suits your circumstances and confirm the total fee before you decide whether to go ahead. The price shown is the total fee, no VAT is added.

I normally aim to provide your draft within seven days of receiving your complete instructions and everything needed to prepare it. If your circumstances are more complex, such as those involving business assets, land or inheritance tax planning, I’ll explain this to you and let you know what to expect.

A Will and an LPA deal with different situations, so it’s worth thinking about both rather than treating them as alternatives. Your Will only takes effect after your death. A Lasting Power of Attorney allows people you choose to make decisions or act on your behalf while you’re still alive, if you’re ever unable to manage your own affairs. You can arrange either on its own, or both together at the same time as your Will.

No. You don’t need a solicitor to make a Will in Oldham, although it must be properly drafted, signed and witnessed in accordance with the law. Many residents across the borough choose an experienced independent will-writing service instead, often benefiting from a more personal service and clearer, more affordable pricing than a traditional solicitor’s firm. I founded Wise Owl Wills after being called to the Bar of England and Wales in 1999, bringing 27 years of experience in the legal profession. What matters when choosing who drafts your Will isn’t whether they’re a solicitor, but whether they have the knowledge, experience and attention to detail to produce a document that’s legally valid and genuinely tailored to your circumstances. To arrange a free consultation, call me on 0161 524 1033 or complete my  contact form.

No. Unmarried partners do not automatically inherit anything under English law, even after many years living together in the same home. There is no such thing as a common law spouse, regardless of how long you have lived together or whether you have children together. This is an important issue for the many cohabiting couples across the Metropolitan Borough of Oldham, since the rules of intestacy only recognise married couples, civil partners and certain blood relatives. Without a valid Will, a surviving partner has no automatic right to the family home, savings or any other assets, even where both partners have contributed financially over many years, and could find themselves in a financially vulnerable position at an already difficult time. The only way to protect an unmarried partner in Oldham is to make a valid Will that expressly names them as a beneficiary. Find out more in my guide to unmarried partner inheritance rights. To make sure your partner is properly protected, call me on 0161 524 1033 or complete my  contact form.

Yes. Your Will is the only way to formally name legal guardians for your children, ensuring they are cared for by someone you trust if the unexpected happens. Without this provision, the decision could be left to the courts, which can cause delay, uncertainty and additional stress for your family at an already difficult time. This is a particularly important consideration for the many young families across the borough, including parents in areas such as Chadderton, Failsworth and Royton. Naming guardians in your Will allows you to clearly set out who you want to raise your children, taking into account family relationships, location and your own personal wishes, rather than leaving such an important decision to default legal processes. Find out more in my guide to appointing guardians for your children. To make sure your children are protected, call me on 0161 524 1033 or complete my  contact form.

Yes. I regularly help blended families across the Oldham borough create Wills that provide fairly and clearly for everyone involved. Blended families often face particular challenges when it comes to inheritance, since a Will written without careful planning can unintentionally leave stepchildren or children from a previous relationship with little or nothing. I take time to understand your family structure, whether that includes children from a current relationship, children from a previous marriage or partnership, or stepchildren you wish to provide for, and draft a Will that reflects your actual wishes rather than relying on default legal rules. This also covers less obvious fairness questions, such as where one child has previously received more financial help than another, for example with a house deposit, which I see regularly among families in Royton. Find out more in my guide to writing a Will for a blended family. To make sure every member of your family is properly provided for, call me on 0161 524 1033 or complete my  contact form.

Yes. I have experience helping families across the Oldham borough protect vulnerable or disabled beneficiaries through carefully structured Wills. Leaving an inheritance directly to a vulnerable beneficiary can sometimes cause unintended problems, such as affecting their entitlement to means-tested benefits or leaving them without the support needed to manage their inheritance safely. I can advise on options such as setting up a trust within your Will, which allows assets to be held and managed on behalf of a vulnerable beneficiary by trustees you choose, ensuring they are properly cared for without putting their benefits or wellbeing at risk. Find out more in my guide to protecting vulnerable beneficiaries in a Will. To discuss how I can help protect a vulnerable family member, call me on 0161 524 1033 or complete my  contact form.

Yes. Any rental properties you own should be specifically addressed within your Will to ensure they are dealt with clearly and according to your wishes. Rental properties often form a significant part of an estate, and without clear instructions, they can be subject to delay during probate or create uncertainty for your beneficiaries about how they should be managed or distributed. This is a relevant consideration for many landlords across the Oldham borough, where rental properties span a wide range of areas and property types, from terraced homes in Oldham Town Centre and Chadderton to larger or higher-value properties in areas such as Saddleworth. I can help ensure your Will clearly identifies each property, sets out your wishes for how they should be distributed or managed, and takes into account related considerations such as outstanding mortgages, letting agreements or Inheritance Tax implications. To make sure your rental properties are properly accounted for, call me on 0161 524 1033 or complete my  contact form.

Yes, and it’s an area worth getting right, since these assets don’t always fit neatly into a standard Will. Many Saddleworth properties, and a number in Lees and Waterhead too, come with more than a typical residential garden: paddocks, outbuildings used for storage, hobbies or small-scale business purposes, or in some cases working farmland or equestrian facilities. If a Will only deals with the main residence and treats everything else as an afterthought, it can create real confusion or delay during probate, particularly where land has its own access arrangements, tenancies, or is used for a business alongside the family home. I address land, outbuildings and any associated business use separately and specifically within your Will, so that each asset is dealt with clearly rather than left for your executors to work out. Where farmland or a smallholding forms part of a wider estate, this can also affect Inheritance Tax planning, since certain agricultural and business assets may qualify for relief, and that’s worth identifying early rather than discovering it too late. To discuss how your land or outbuildings should be addressed, call me on 0161 524 1033 or complete my  contact form.

Yes, and for many households across Oldham this matters more than the standard intestacy rules assume. Oldham has one of the larger average household sizes in Greater Manchester, and close, multi-generational family ties, parents, adult children and grandchildren living near one another or under one roof, are common in areas including Lees, Springhead and Grotton, and Waterhead. The intestacy rules that apply when someone dies without a Will only recognise a narrow list of relationships: a spouse or civil partner, then children, then a small set of blood relatives. They take no account of a sibling you’ve lived alongside for years, a relative who has been your long-term carer, or anyone else outside that fixed list, however close the relationship actually is. A Will lets you name exactly who you want to benefit, in whatever proportion you choose, regardless of whether the law would otherwise recognise that relationship. This is one of the most overlooked reasons to make a Will rather than assume family will simply sort things out fairly between themselves. To make sure the people who actually matter to you are provided for, call me on 0161 524 1033 or complete my  contact form.

Making a Will should be high on your list alongside the mortgage paperwork, and it’s a step first-time buyers across Oldham Town Centre, Failsworth and Royton in particular tend to overlook. The first question is how you own the property. If you own it as joint tenants, your share passes automatically to your partner on your death regardless of whether you have a Will. If you own it as tenants in common, your share forms part of your estate and doesn’t pass automatically, which makes a Will essential to ensure your partner inherits it. If you’re not married, the position is even more urgent: an unmarried partner has no automatic right to inherit from you under the intestacy rules of England and Wales, regardless of how long you’ve lived together or how much you’ve both put into the property. Without a Will, your share could pass to a blood relative rather than to your partner, potentially forcing a sale of the home at the worst possible time. Even if you’re married, making Wills together at the point of purchase ensures your home, savings and any other assets are directed exactly as you intend from day one. To arrange a free consultation, call me on 0161 524 1033 or complete my  contact form.

Without a Will, what happens to your share of a business is decided by the intestacy rules in the same way as the rest of your estate, and that is rarely the outcome a business owner would choose. Your share could pass to family members who have no interest or involvement in running the business, which can create serious difficulties for surviving business partners as well as for your own family. This is a genuine issue across the borough, from independent shops and professional practices in Oldham Town Centre and Failsworth to rural enterprises in Saddleworth. A Will lets you deal with this properly: leaving your share to a specific person, making provision for a business partner to buy out your share, or coordinating your Will with any partnership agreement, shareholders’ agreement or cross-option agreement already in place. It’s also worth checking whether your business qualifies for Business Relief, which can reduce the Inheritance Tax payable on qualifying business assets, since this is often overlooked until it’s too late to plan around it properly. Possibly, and it’s a question more Saddleworth homeowners need to ask than many might expect. Inheritance Tax is currently charged at 40% on the value of an estate above the available tax-free threshold. For most individuals, the standard nil rate band is £325,000. If you’re leaving your home to your children or grandchildren, you may also be entitled to the residence nil rate band, which can add a further £175,000 to your threshold. For a married couple or civil partners, these allowances can be combined, meaning a joint estate of up to £1 million may pass free of Inheritance Tax in the right circumstances. Saddleworth’s villages, including Uppermill, Delph, Dobcross, Diggle, Greenfield and Grasscroft, include some of the higher-value property in the Oldham borough, and where that’s combined with savings, investments, business assets or land, a total estate that triggers an Inheritance Tax liability is not uncommon. The rules around Inheritance Tax can be complex, and there are a number of legitimate ways to reduce a potential liability, including available allowances, gifting strategies and certain types of trust, depending on your individual circumstances.
