Stephen at Wise Owl Wills
We asked Stephen at Wise Owl Wills to prepare our mirror Wills and a letter of wishes. He listened carefully to what we wanted, explained our options clearly and helped us put our wishes into words. Stephen explained how the Wills would provide for each other and our family, and how the letter of wishes could offer additional guidance alongside them. We appreciated having time to ask questions and discuss the details. The personal service made the whole process straightforward and reassuring. We would recommend Wise Owl Wills to couples looking for professionally drafted Wills and thoughtful, practical guidance.

Who a Health and Welfare LPA is right for
A Health and Welfare LPA is usually worth putting in place if:
- you want a genuine say in who makes decisions about your care and treatment if you are ever unable to make them yourself, rather than leaving it to whoever happens to be involved at the time
- you are already arranging a Will, or a Property and Financial Affairs LPA, and want your health and welfare decisions covered at the same time
- you or a family member has received a diagnosis that may affect your ability to make decisions in future, and you want to plan while you still have full capacity
- you want to name a particular person you trust, rather than leave decisions to be worked out between family members and medical professionals after the event
A Health and Welfare LPA only covers decisions about your care and medical treatment; it has no bearing on your money or property. Most clients choose to put a Property and Financial Affairs LPA in place at the same time. If you also want to record your own decisions about refusing specific treatment in advance, a Living Will can sit alongside your LPA.

Who will prepare your LPA
Wise Owl Wills was founded by Stephen Rhodes, who was called to the Bar in 1999 and has 27 years of legal experience. You deal directly with Stephen throughout, from your first conversation to the completion of your documents.
Health and Welfare LPAs: frequently asked questions
Doesn't my next of kin have the right to decide anyway?
No. Being next of kin, or even a spouse, gives no legal authority to make health or care decisions for you. Without an LPA, those decisions are made by the professionals involved in your care, in what they judge to be your best interests, and your family can be consulted but cannot insist.
When can my attorney use a Health and Welfare LPA?
Only once the LPA has been registered with the Office of the Public Guardian, and only when you are unable to make the particular decision yourself. While you can decide for yourself, you remain in control.
What is the life-sustaining treatment choice?
When you make the LPA, you choose whether your attorney can make decisions about life-sustaining treatment on your behalf. It is one of the most important decisions in the document, and I will explain it carefully before you choose.
Can I still make an LPA after a diagnosis?
Yes, as long as you have the mental capacity to make it at the time. If you or a family member has received a diagnosis that may affect decision-making in future, it is best not to wait.
Who can I appoint as my attorney?
Anyone aged 18 or over who has mental capacity and whom you trust. You can appoint more than one attorney, and replacement attorneys to step in if needed. We will talk through the right arrangement for you.
Do I pay the full £92 registration fee?
Not necessarily. The Office of the Public Guardian offers a reduced fee if you have a low income, and an exemption if you receive certain means-tested benefits. I can tell you whether you are likely to qualify.
