Why choose Wise Owl Wills

27 years of legal experience focused on you and your family.

Wise Owl Wills was founded by Stephen Rhodes, who was called to the Bar in 1999 and has 27 years of legal experience. Having drafted Wills and dealt with disputes arising from poorly prepared or unclear Wills, Stephen understands both how these important documents should be prepared and what can go wrong when someone’s wishes are not expressed properly. You deal directly with Stephen throughout, from your first conversation to the completion of your documents.

Wise Owl Wills is an independent Will-writing and estate-planning business, not a barristers’ practice, and Stephen does not provide these services in the capacity of a practising barrister. Instead, you receive the benefit of his extensive legal knowledge and experience through a personal, approachable service, with clear explanations, fixed fees agreed in advance and no unnecessary legal jargon.

Whether you require a Will, Lasting Power of Attorney or Living Will, Stephen will take the time to understand your circumstances, explain the available options and prepare documents tailored to your needs and wishes. His aim is to make planning for the future feel straightforward and reassuring, while ensuring that you can make informed decisions with confidence.

A clear Will that reflects your life and your wishes

A Will gives you control over what should happen to your estate, who should deal with it and how the people you care about should be provided for. Without one, the intestacy rules decide who inherits. Those rules cannot take account of informal promises, personal relationships or the individual reasons behind your choices.

I help people throughout Rochdale put properly considered arrangements in place. This includes individuals and couples making their first Wills, parents choosing how children should be provided for, homeowners considering trust provisions and families whose circumstances do not fit a standard template.

Every Will is prepared personally. I take time to understand your family, property and priorities, explain the available options in plain English and agree the fee before any drafting begins. You will not be directed through an automated Will builder or left to choose legal clauses without guidance.

A Will deals with what happens after your death. If you also want to choose who could make financial, health or welfare decisions during your lifetime, or record particular medical treatments you would refuse, I can prepare Lasting Powers of Attorney and a Living Will as part of the same planning exercise.

Professional Will writing across Rochdale

Rochdale brings together the busy streets of the town centre and Middleton, the established neighbourhoods of Heywood, Castleton and Kirkholt, and the more rural surroundings of Littleborough, Wardle, Norden and Bamford, but the question that matters is personal: if something happened to you, would the law hand your home and your savings to the people you’d actually choose? A professionally drafted Will can address the people, property and responsibilities that matter in your own life.

The case for having one in place is particularly strong here. Rochdale’s median age is 38, below the England and North West average of 40, and the borough has a significant number of families with dependent children. Rochdale also has one of the highest rates of social rented housing of any local authority in England, at 20.9% of households, well above the England average of 17.1%, alongside 19% of residents recognised as disabled under the Equality Act and 9% who provide unpaid care, both notably high figures. For a Rochdale parent, that combination means the question of who would care for your children if something happened to you needs a clear legal answer, one that only a Will can give. For the many households where a family member relies on care from a relative, or provides it, it means making sure that relationship is properly recognised, since the intestacy rules that apply without a Will take no account of it at all.

A Will may be particularly important for unmarried couples, parents, blended families and anyone who wishes to protect a young or vulnerable beneficiary. The right structure depends upon your circumstances, which is why the consultation comes before the drafting.

As the commercial and residential heart of the borough, Rochdale Town is home to a fast-changing population, including many young renters, first-time buyers benefiting from regeneration investment, and long-standing local families with deep roots in the area. This mix creates a wide range of Will-writing needs.

For younger residents and first-time property owners, many of whom may never have considered a Will before, I provide clear, jargon-free guidance that explains exactly why having a Will matters, even when an estate feels modest. Many residents in the town centre also live in private rented accommodation or shared family homes, meaning a Will is essential to clearly set out who should receive savings, personal possessions and any other assets, since these arrangements are not always covered by default legal rules.

I also regularly assist unmarried couples living together in the town centre, making sure their partner is protected and provided for, something the law does not guarantee automatically.

At Wise Owl Wills, I offer convenient appointment options across Rochdale Town Centre, including evening and weekend availability to suit working residents, plus telephone and video consultations. My straightforward, fixed fee approach means there are no hidden costs, just clear professional advice tailored to your circumstances and your community.

As one of the borough’s most sought-after residential areas, Bamford attracts professionals and families drawn by its strong schools, spacious housing and pleasant surroundings. This creates specific and often more involved Will-writing needs.

For homeowners with significant property wealth, ensuring the largest part of the estate is protected and passed on according to personal wishes is often the central concern, particularly where Inheritance Tax may become a relevant consideration. Many Bamford families also want to provide thoughtfully for children and grandchildren, sometimes including trusts within a Will to protect inheritance until beneficiaries reach an appropriate age.

Parents across the area place high importance on guardianship arrangements, wanting full confidence that their children would be cared for by someone they trust without court involvement. I also support residents in blended families, ensuring that both biological and stepchildren are provided for according to personal wishes, something that does not happen automatically without a Will.

At Wise Owl Wills, I offer a personal, attentive service across Bamford, with free home visits, telephone and video consultations available for busy professional households. My transparent fixed fee approach ensures clear, upfront pricing, even for more complex estates, backed by experienced and knowledgeable advice.

Castleton’s strong sense of community and long-standing local families mean that many residents have close ties to the area spanning multiple generations, often living near siblings, parents or grandparents. This creates particular priorities when it comes to Will writing.

For households with more limited assets, I make clear that a Will is not just for the wealthy, it is the only way to ensure that everything you own, no matter the value, is passed on according to your own wishes rather than a fixed legal formula that ignores personal relationships and circumstances. I frequently help Castleton residents provide for specific family members beyond their immediate household, including informal arrangements such as supporting a relative who has been a long-term carer, something that would not be recognised at all without a clearly written Will.

Parents in the area also prioritise guardianship provisions, wanting certainty about who would care for their children if anything happened to them. For residents renting their home or living in family-owned property, a Will helps clarify exactly what happens to personal possessions and any savings, avoiding confusion among family members during an already difficult time.

At Wise Owl Wills, I provide a friendly, approachable service across Castleton, with free home visits for those who prefer to discuss matters at home, plus telephone and video consultations. My transparent fixed fees mean every resident can access professional Will writing without unexpected costs.

With its proud industrial heritage and strong community spirit, Heywood is home to many long-established families, as well as a number of small business owners and tradespeople who have built their livelihoods locally over many years. This combination creates specific and practical Will-writing needs.

For business owners, ensuring a clear plan is in place for what happens to the business, whether that means passing it to a family member or arranging for an orderly sale, can make a significant difference to both the business and the family left behind. Many Heywood households also include several generations of the same family living in the area, and a Will allows residents to make specific provisions reflecting these close, long-standing family ties.

Parents across Heywood also prioritise naming guardians for their children, wanting full certainty that their wishes would be followed without unnecessary court involvement. I also support residents reviewing Wills that have become outdated due to a change in business circumstances, a new relationship or the arrival of grandchildren.

At Wise Owl Wills, I provide a personal, attentive service throughout Heywood, with free home visits for those who prefer to discuss matters from home, as well as telephone and video consultations. My transparent fixed fees mean residents can put a properly drafted Will in place with complete confidence.

Kirkholt’s strong sense of community means that many residents have close ties to the area, often living near siblings, parents or grandparents, with support networks built up over many years.

I frequently help Kirkholt residents provide for specific family members beyond their immediate household, including informal arrangements such as supporting a relative who has taken on a long-term caring role, something that would not be recognised at all without a clearly written Will.

Parents in the area also prioritise guardianship provisions, wanting certainty about who would care for their children if anything happened to them. For residents in rented or social housing, a Will helps clarify exactly what happens to personal possessions and any savings, avoiding confusion among family members during an already difficult time.

At Wise Owl Wills, I provide a friendly, approachable service across Kirkholt, with free home visits for those who prefer to discuss matters at home, plus telephone and video consultations. My transparent fixed fees mean every resident can access professional Will writing without unexpected costs

With its Pennine setting and larger period properties, Littleborough appeals to residents who have built up significant property wealth, often including land, paddocks or outbuildings beyond a typical residential garden. This creates specific and often more involved Will-writing needs.

For homeowners with higher-value estates, Inheritance Tax planning becomes an important consideration, and a carefully drafted Will can help structure an estate in a way that minimises unnecessary liability while still reflecting personal wishes. I also work with residents who own smallholdings or equestrian properties, where specific provisions are needed to ensure land and associated assets are dealt with correctly and pass on smoothly to chosen beneficiaries.

Many Littleborough families want to provide thoughtfully for grandchildren, sometimes including trusts within a Will to protect inheritance for younger beneficiaries. Parents across the area also prioritise guardianship provisions, wanting full certainty about who would care for their children if necessary.

At Wise Owl Wills, I provide a discreet, thorough service across Littleborough, with free home visits, telephone and video appointments available. My fixed fee structure ensures transparent pricing even for more complex estates, backed by experienced, professional guidance.

As one of the most populous towns in the borough, Middleton attracts a wide range of residents, from long-established families to commuting professionals and a strong base of local business owners. This variety brings a range of practical Will-writing needs.

For homeowners who have lived in the area for many years, ensuring property passes smoothly to chosen beneficiaries is often the central concern, particularly where a family home represents the majority of the estate. Many local families also want to make specific provisions for adult children, especially where one child has remained nearby and provided ongoing support to parents, while others have moved away.

Business owners across Middleton also benefit from clear succession planning within their Will, helping to protect the business and provide certainty for employees and family members involved in running it. Parents of younger children prioritise guardianship arrangements, wanting clear, legally recognised instructions about who would raise their children if necessary.

At Wise Owl Wills, I offer evening and weekend appointments alongside free home visits, telephone and video consultations, ensuring residents of Middleton can put a properly drafted Will in place without unnecessary cost, delay or inconvenience to their working life.

With its mix of established neighbourhoods and newer residential developments, Milnrow appeals to a broad range of residents, from long-term local families to young couples taking their first step onto the property ladder. This variety brings a range of practical Will-writing needs.

For first-time buyers, ensuring a new mortgage and any savings are protected and pass to the right people is often the starting point for a first Will, and I explain clearly why this matters even early in life. Many local families also want to make specific provisions for children, particularly where one parent has taken on a greater share of childcare or financial responsibility.

Parents of younger children prioritise guardianship arrangements, wanting clear, legally recognised instructions about who would raise their children if necessary. I also work with a number of unmarried couples in Milnrow who are raising children or who own property together, helping them understand that without a Will, a surviving partner could be left with no automatic right to inherit.

At Wise Owl Wills, I offer evening and weekend appointments alongside free home visits, telephone and video consultations, ensuring residents of Milnrow can put a properly drafted Will in place without unnecessary cost or inconvenience.

As one of the borough’s most desirable residential areas, Norden attracts professionals and established families drawn by its spacious housing, semi-rural setting and strong local amenities. This creates specific and often more involved Will-writing needs.

For homeowners with significant property wealth, ensuring the largest part of the estate is protected and passed on according to personal wishes is often the central concern, particularly where Inheritance Tax may become a relevant consideration. Many Norden families also want to provide thoughtfully for children and grandchildren, sometimes including trusts within a Will to protect inheritance until beneficiaries reach an appropriate age.

Parents across the area place high importance on guardianship arrangements, wanting full confidence that their children would be cared for by someone they trust without court involvement. I also support residents in blended families, ensuring that both biological and stepchildren are provided for according to personal wishes, something that does not happen automatically without a Will.

At Wise Owl Wills, I offer a personal, attentive service across Norden, with free home visits, telephone and video consultations available for busy professional households. My transparent fixed fee approach ensures clear, upfront pricing, even for more complex estates, backed by experienced and knowledgeable advice.

With its village-like character and close-knit community, Wardle is home to many long-term residents who have built up significant equity in family homes, alongside a number of properties with larger plots, outbuildings or land that goes beyond a typical residential garden. This combination creates specific Will-writing needs.

For residents with additional land or outbuildings, whether used for storage, hobbies or small-scale business purposes, it is important that a Will clearly addresses these assets separately from the main residence to avoid confusion or delay during probate. Many Wardle families also have strong multi-generational ties, with grandparents, parents and children often living close to one another, making it important to set out clear and specific wishes to prevent misunderstandings among family members.

Parents across the area also prioritise naming legal guardians for their children, wanting reassurance that their wishes would be respected and followed without hesitation. I also assist residents reviewing Wills that have become outdated due to property improvements, family growth or changes in personal relationships.

At Wise Owl Wills, I provide a personal, unhurried service across Wardle, with free home visits for those who prefer to discuss their Will at home, as well as telephone and video consultations. My transparent fixed fees and clear documentation give Wardle residents complete confidence that their property, land and family are properly protected.

Lasting Powers of Attorney and Living Wills

Many clients first contact me because they need a Will and then ask whether they should make arrangements for decisions during their lifetime. I also prepare Lasting Powers of Attorney and Living Wills. These can be arranged alongside your Will or as separate services.

Lasting Powers of Attorney

Blue illustration of a Lasting Power of Attorney document with a pen and official seal

A Lasting Power of Attorney allows you to appoint trusted people to make particular decisions or act for you. A Property and Financial Affairs LPA can cover matters such as bank accounts, bills, investments and property. A Health and Welfare LPA can cover care, medical treatment and where you live, but it can be used for a particular decision only when you lack capacity to make that decision yourself.

Lasting Power of Attorney fixed fees

Choose a Property and Financial Affairs LPA, a Health and Welfare LPA, or both, and give people you trust the authority to act if you can no longer make particular decisions yourself.

Office of the Public Guardian registration fee: £92 for each LPA, payable to the OPG when you register your LPA. A reduction or exemption may be available depending upon the donor’s income or benefits.

Living Wills

Illustrated Living Will document with a pen, signature and blue seal

A Living Will, formally called an Advance Decision to Refuse Treatment, records specified medical treatments that you wish to refuse in defined future circumstances if you cannot make or communicate the decision at that time. It serves a different purpose from a Health and Welfare LPA, although the two documents are sometimes considered together.

Living Wills fixed fees

Choose the Will that provides the right protection for you and your family. Every Will is personally prepared for your circumstances, with clear guidance and a fixed fee agreed before drafting begins.

Telephone and video appointments are also available if you’d prefer to arrange your Will remotely. I work with homeowners, tenants, young families, business owners and residents with property in more rural areas, and I tailor my advice accordingly. To arrange a free consultation, call me on 0161 524 1033 or complete my  contact form.

Yes. I offer free home visits to clients across the Metropolitan Borough of Rochdale. Whether you live in Rochdale Town Centre, Bamford, Castleton, Heywood, Kirkholt, Littleborough, Middleton, Milnrow, Norden or Wardle, I can come to you at a time that suits you. Home visits are particularly valued by older residents, busy parents and those with mobility concerns, giving you the opportunity to talk through your circumstances in a relaxed environment with no need to travel or arrange childcare. If a home visit isn’t convenient, telephone and video appointments are also available. To arrange a free home visit, call me on 0161 524 1033 or complete my  contact form.

Yes. Your instructions can be taken by telephone or video, and you’ll receive the same personal discussion and tailored drafting as you would during a home visit. I’ll also explain exactly how your completed Will needs to be signed and witnessed to be legally valid, since that’s the one part of the process you’ll need to arrange yourself wherever you are.

A Will records what should happen to your estate after your death. A Lasting Power of Attorney appoints people you trust to make decisions or act on your behalf during your lifetime, if you’re ever unable to do so yourself. A Living Will (formally an Advance Decision to Refuse Treatment) records specific medical treatments you would refuse in defined future circumstances. Many clients arrange a Will on its own; others choose to put an LPA or Living Will in place at the same time. Find out more about Lasting Powers of Attorney and Living Wills.

A Single Will costs £130 and Mirror Wills for a couple cost £200. A detailed Will including a trust costs £200, or £300 for detailed mirror Wills for a couple. I’ll explain which option suits your circumstances and confirm the total fee before you decide whether to go ahead. The price shown is the total fee, no VAT is added.

I normally aim to provide your draft within seven days of receiving your complete instructions and everything needed to prepare it. If your circumstances are more complex, such as those involving business assets, land or Inheritance Tax planning, I’ll explain this to you and let you know what to expect.

A Will and an LPA deal with different situations, so it’s worth thinking about both rather than treating them as alternatives. Your Will only takes effect after your death. A Lasting Power of Attorney allows people you choose to make decisions or act on your behalf while you’re still alive, if you’re ever unable to manage your own affairs. You can arrange either on its own, or both together at the same time as your Will.

No. You don’t need a solicitor to make a Will in Rochdale, although it must be properly drafted, signed and witnessed in accordance with the law. Many residents across the borough choose an experienced independent will-writing service instead, often benefiting from a more personal service and clearer, more affordable pricing than a traditional solicitor’s firm. I founded Wise Owl Wills after being called to the Bar of England and Wales in 1999, bringing 27 years of experience in the legal profession. What matters when choosing who drafts your Will isn’t whether they’re a solicitor, but whether they have the knowledge, experience and attention to detail to produce a document that’s legally valid and genuinely tailored to your circumstances. To arrange a free consultation, call me on 0161 524 1033 or complete my  contact form.

No. If you live with your partner but are not married or in a civil partnership, having a Will is essential, since your partner has no automatic right to inherit anything from your estate. There is no such thing as a common law spouse in England and Wales, regardless of how long you have lived together or whether you own a home or have children together. This is a particularly important consideration for the many cohabiting couples across the Metropolitan Borough of Rochdale, since without a valid Will, the rules of intestacy only recognise married couples, civil partners and certain blood relatives. This could leave your partner with no legal claim to the family home, savings or other assets, potentially causing significant financial hardship at the same time as coping with bereavement. Find out more in my guide to unmarried partner inheritance rights. To make sure your partner is properly protected, call me on 0161 524 1033 or complete my  contact form.

Yes. Your Will is the only way to formally name legal guardians for your children, ensuring they are cared for by someone you trust if the unexpected happens. Without this provision, the decision could be left to the courts, which can cause delay, uncertainty and additional stress for your family at an already difficult time. This is a particularly important consideration for the many young families across the borough, including parents in areas such as Middleton, Heywood and Milnrow. A Will also allows you to set out clear financial provisions for your children, including how and when they should inherit, giving you control over their future rather than leaving it to default legal rules. Find out more in my guide to appointing guardians for your children. To make sure your children are protected, call me on 0161 524 1033 or complete my  contact form.

Yes. If you have children from a previous relationship, a carefully drafted Will is essential to make sure they are clearly and fairly provided for, alongside any other children or a current spouse or partner. Without a Will, the rules of intestacy may not reflect your actual wishes, and could result in children from a previous relationship, or stepchildren, receiving less than intended, or being excluded entirely, since stepchildren have no automatic right to inherit under the intestacy rules regardless of how close the relationship is. This is a common and important consideration for blended families across the Metropolitan Borough of Rochdale, where remarriage and new family relationships are increasingly common. I take the time to understand your full family situation, including children from current and previous relationships, and help you structure your Will so that your wishes are clearly recorded and your estate is divided exactly as you intend. Find out more in my guide to writing a Will for a blended family. To make sure all of your children are properly provided for, call me on 0161 524 1033 or complete my  contact form.

Yes. I have experience helping families across the Metropolitan Borough of Rochdale protect vulnerable or disabled beneficiaries through carefully structured Wills. Leaving an inheritance directly to a vulnerable beneficiary can sometimes cause unintended problems, such as affecting their entitlement to means-tested benefits or leaving them without the support needed to manage their inheritance safely. I can advise on options such as setting up a trust within your Will, which allows assets to be held and managed on behalf of a vulnerable beneficiary by trustees you choose, ensuring they are properly cared for without putting their benefits or wellbeing at risk. This is a particularly relevant option in Rochdale, where 19% of residents are recognised as disabled under the Equality Act, one of the higher rates in Greater Manchester. Find out more in my guide to protecting vulnerable beneficiaries in a Will. To discuss how I can help protect a vulnerable family member, call me on 0161 524 1033 or complete my  contact form.

Yes. A Will is not just for homeowners, and this matters more in Rochdale than in most of Greater Manchester: the borough has one of the highest rates of social rented housing of any local authority in England, at 20.9% of households, well above the national average of 17.1%. Whether you rent from a housing association, the council, or privately, a Will is the only way to ensure that your savings, personal possessions and any other assets you own are passed on according to your own wishes rather than a fixed legal formula that takes no account of your relationships or circumstances. This is particularly relevant for renters in areas such as Kirkholt and Rochdale Town Centre, where I regularly help tenants set out clearly who should benefit from what they own, appoint a guardian for their children if they have any, and make sure an unmarried partner is protected, since none of that happens automatically without a Will. To put a Will in place regardless of whether you own or rent your home, call me on 0161 524 1033 or complete my  contact form.

Yes, how you hold a property jointly with your partner can have a significant impact on what happens to it after one of you dies. Properties are generally held either as joint tenants, where the property automatically passes to the surviving owner regardless of what a Will says, or as tenants in common, where each person owns a defined share that can be left to whoever they choose in their Will. This distinction is particularly important for couples across the Rochdale borough who have children from a previous relationship, want to leave their share of the property to someone other than their partner, or are looking at care fee planning, since holding a property as tenants in common can open up additional options that are not available as joint tenants. Read more about the difference between joint tenants and tenants in common. To find out which option may be right for your circumstances, call me on 0161 524 1033 or complete my  contact form.

Yes, and this is one of the most important questions I’m asked by clients in Rochdale specifically. The borough has a notably high proportion of unpaid carers, 9% of residents according to the 2021 Census, and close, multi-generational family ties, parents, adult children and grandchildren living near one another or supporting each other informally, are common in areas including Castleton and Kirkholt. The intestacy rules that apply when someone dies without a Will only recognise a narrow list of relationships: a spouse or civil partner, then children, then a small set of blood relatives. They take no account of a sibling who has been your long-term carer, a relative who has supported you for years, or anyone else outside that fixed list, however close the relationship actually is or however much they’ve done for you. A Will lets you name exactly who you want to benefit, in whatever proportion you choose, regardless of whether the law would otherwise recognise that relationship. To make sure the person who has actually looked after you is properly provided for, call me on 0161 524 1033 or complete my  contact form.

There are a number of legitimate planning options that may help protect part of your home’s value from future care fees, although the right approach depends entirely on your personal circumstances. Options sometimes considered include placing property into a trust, such as on the death of the first spouse or partner in a couple, which can help protect a share of the property’s value for chosen beneficiaries. This is a relevant concern for many homeowners across the Rochdale borough, particularly in areas such as Bamford and Norden, where property values are higher and residents have often built up significant equity over many years. It is important to seek advice early, since some planning options are only effective if put in place well in advance and in the right circumstances, and attempting to give away assets deliberately to avoid care fees can be treated as deprivation of assets by a local authority. Read more in my guide to protecting your home from care fees. To find out whether care fee planning could be right for you, call me on 0161 524 1033 or complete my  contact form.

Possibly. If rising property values mean the total value of your estate now exceeds the available Inheritance Tax thresholds, your beneficiaries could face a tax charge of up to 40% on the amount above that threshold. This is an increasingly relevant consideration for homeowners across the Rochdale borough, particularly in areas such as Bamford, Norden and Littleborough, where property values have risen significantly over recent years. For most individuals, the standard nil rate band is £325,000, with a further £175,000 residence nil rate band available where a home is left to children or grandchildren, and these allowances can be combined for married couples and civil partners to give a joint threshold of up to £1 million in the right circumstances. The rules can be complex, and there are a number of legitimate ways to reduce a potential liability, including available allowances, gifting strategies and certain types of trust, depending on your individual circumstances. Read more in my guide to Inheritance Tax. To find out whether Inheritance Tax planning could benefit your estate, call me on 0161 524 1033 or complete my  contact form.

Without a Will, what happens to your share of a business is decided by the intestacy rules in the same way as the rest of your estate, and that is rarely the outcome a business owner would choose. Your share could pass to family members who have no interest or involvement in running the business, which can create serious difficulties for surviving business partners as well as for your own family. This is a genuine issue across Rochdale, particularly in Heywood and Middleton, both home to a strong base of small business owners and tradespeople who have built their livelihoods locally over many years. A Will lets you deal with this properly: leaving your share to a specific person, arranging for an orderly sale, or coordinating your Will with any partnership agreement, shareholders’ agreement or cross-option agreement already in place, so the business and your family are both protected. To discuss how your business fits into your wider estate, call me on 0161 524 1033 or complete my  contact form.
