A Lasting Power of Attorney lets you choose someone you trust, your attorney, to act for you if you are ever unable to act for yourself. The two types of Lasting Power of Attorney

Each LPA covers a different part of your life, and neither one covers the other.

Property and Financial Affairs LPA

Lets your attorney manage your bank accounts, bills, pensions, savings and property. You choose whether your attorney can act straight away, with your permission, while you still have capacity, or only once you have lost it.

Health and Welfare LPA

Lets your attorney make decisions about your medical treatment, daily routine and where you live, including any move into a care home. It can only be used when you are unable to make the particular decision yourself, and you choose whether your attorney can decide about life-sustaining treatment.

Who should make a Lasting Power of Attorney?

An LPA is usually worth putting in place if:

  • you want to choose who acts for you if you are ever unable to act for yourself, rather than leaving it to a court or to whoever happens to be involved at the time
  • you own your home, savings or investments, and want to avoid your family being unable to access your accounts or sell your home if you lose capacity without anyone in place to act
  • you or a family member has received a diagnosis that may affect your ability to make decisions in future, and you want to plan while you still have full capacity
  • you would welcome practical help with your finances while you are still perfectly capable, for example during a stay in hospital or long periods abroad
  • you are already arranging a Will and want the decisions that matter during your lifetime covered as part of the same planning

Most clients choose to put both LPAs in place at the same time, and doing both together costs £150 rather than £200. If you also want to record your own decisions about refusing specific treatment in advance, a Living Will can sit alongside your LPAs.

Who will prepare your LPA

Wise Owl Wills was founded by Stephen Rhodes, who was called to the Bar in 1999 and has 27 years of legal experience. Having drafted Wills and dealt with disputes arising from poorly prepared or unclear Wills, Stephen understands both how these important documents should be prepared and what can go wrong when someone’s wishes are not expressed properly. You deal directly with Stephen throughout, from your first conversation to the completion of your documents.

Lasting Powers of Attorney: frequently asked questions

Do I need both types of LPA?

Not necessarily, but most people benefit from both. A Property and Financial Affairs LPA gives your attorney no authority over your care or treatment, and a Health and Welfare LPA gives no authority over your money. With only one in place, nobody has authority over the other part of your life. I will help you decide what you need at your consultation.

No. Being next of kin, or even a spouse, gives no legal authority to deal with your money or to make decisions about your care. Without LPAs, your family would usually have to apply to the Court of Protection to manage your finances, which is slower and more expensive, and decisions about your care would be made by the professionals involved in it.

Yes. Many people appoint the same people for both, but you can choose, for example, a relative who is good with money for your finances and someone closer to your daily life for your care.

Only once the LPA has been registered with the Office of the Public Guardian. A Health and Welfare attorney can act only when you are unable to make the particular decision yourself. With a Property and Financial Affairs LPA, you choose whether your attorney can act straight away, with your permission, or only once you have lost capacity.

Yes. Each of you needs your own LPAs, because an LPA only covers the person who makes it, but I can talk through both of yours at the same visit. Fees are per person.

Not necessarily. The Office of the Public Guardian offers a reduced fee if you have a low income, and an exemption if you receive certain means-tested benefits. I can tell you whether you are likely to qualify.
